 Domestic Violence (DV) Defined in Colorado

Domestic violence in Denver and throughout Colorado is defined:

 An act of violence, or any other crime, against a person with whom the actor is, or has been, involved in an intimate relationship, when that crime is used as “a method of coercion, control, punishment, intimidation, or revenge…”.

Domestic violence crimes in Colorado are not in and of themselves individual criminal offenses.  It is what the law calls an “enhancer” that attaches to another individual criminal offense such as assault, battery, menacing, harassment, stalking, criminal mischief or violation of a restraining order.

Law enforcement are required by Colorado law to arrest a person who is accused of domestic violence when the officer believes that there is probable cause that a criminal act of domestic violence has occurred.  The law also requires that a person who arrested for a domestic violence crime be held without bond until he or she appears before a judge.  In other words, when accused of domestic violence, you will be arrested and you will not be allowed to post bail until you see a judge.  This very often means that you will spend at least one night in jail.
